TERMS OF SERVICE

Last Updated: September 21, 2026

These Terms of Service (“Terms”) are a legal agreement between ChowMore (“ChowMore,” “we,” “us,” or “our”) and you (“you” or “your”) governing your access to and use of chowmore.com (the “Website”), your purchase and use of ChowMore products (“Products”), and related services, features, subscriptions, customer-support services, and functionality we provide (collectively, the “Services”).

BY ACCESSING OR USING THE SERVICES, CREATING AN ACCOUNT, OR PURCHASING PRODUCTS, YOU AGREE TO BE BOUND BY THESE TERMS AND THE POLICIES INCORPORATED INTO THEM BY REFERENCE. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES OR PURCHASE PRODUCTS.

IMPORTANT NOTICE REGARDING DISPUTES: SECTION 19 CONTAINS AN ARBITRATION AGREEMENT AND CLASS-ACTION WAIVER THAT MAY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO HAVE CERTAIN DISPUTES DECIDED BY A COURT OR JURY. PLEASE READ THAT SECTION CAREFULLY.

1. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering into a binding agreement to make purchases or create a customer account through the Services.

When creating an account or placing an order, you agree to provide accurate, current, and complete information and to update that information when reasonably necessary.

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account to the extent permitted by applicable law.

You may not use false identities, unauthorized payment methods, multiple accounts, or other methods to circumvent purchase limits, promotion restrictions, fraud-prevention measures, or other restrictions associated with the Services.

We may suspend, restrict, or terminate an account where reasonably necessary to address suspected fraud, abuse, security risks, unlawful activity, violations of these Terms, or conduct that may harm ChowMore, our customers, or the Services.

2. Products, Nutrition, and Veterinary Disclaimer

ChowMore provides pet-food products and related information.

Information provided through the Website, product pages, feeding guides, FAQs, customer support, social media, marketing materials, or other ChowMore communications is provided for general informational purposes and is not intended to constitute veterinary medical advice, diagnosis, or treatment.

Use of ChowMore's Services or communications does not establish a veterinarian-client-patient relationship.

Individual dogs may have different nutritional requirements depending on factors including age, weight, activity level, reproductive status, environment, health, allergies, sensitivities, and other individual characteristics.

Customers should consult a qualified veterinarian regarding medical conditions, allergies, dietary restrictions, significant dietary changes, or other concerns specific to their pets.

3. Ingredients, Allergies, and Product Suitability

Customers are responsible for reviewing applicable product labels and ingredient information before feeding a Product, particularly if a dog has known or suspected allergies, food sensitivities, medical conditions, or specialized dietary requirements.

ChowMore's complete-and-balanced or life-stage representations, where applicable, are based on the nutritional formulation and labeling applicable to the particular Product.

Such representations do not mean that every Product is appropriate for every individual dog regardless of the dog's medical condition or individual nutritional needs.

Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited.

4. Product Information, Packaging, Storage, and Safety

We make reasonable efforts to accurately display Product information, photographs, descriptions, ingredients, packaging, sizes, and other information.

Product packaging, labeling, appearance, ingredients, formulations, or other Product characteristics may change from time to time.

Customers should review the physical Product label and packaging received before feeding the Product.

If information displayed on the Website appears materially inconsistent with the physical Product label, please contact ChowMore Customer Care before use if you have questions.

Customers are responsible for following applicable storage, handling, refrigeration-after-opening, feeding, and use instructions appearing on Product packaging.

Do not feed a Product if its packaging is materially compromised, swollen, leaking, unusually damaged, or otherwise appears unsafe. Please contact ChowMore Customer Care if you believe a Product is defective or compromised.

5. Feeding Guidelines

Feeding amounts and other feeding information provided by ChowMore are general guidelines.

Actual caloric and nutritional requirements vary among individual dogs. Customers should monitor their dog's condition and individual needs and adjust feeding appropriately, including in consultation with a veterinarian where appropriate.

When changing a dog's diet, customers should consider transitioning foods gradually when appropriate.

6. Product Safety and Recalls

If ChowMore becomes aware of a Product recall, significant safety notice, or another Product issue requiring customer action, we may contact affected customers using contact information associated with their accounts or orders.

Product-safety, recall, security, transactional, and other important service communications are not marketing communications and may be sent regardless of your marketing preferences where permitted by applicable law.

Customers should follow applicable instructions contained in any Product recall or safety notice.

7. Orders and Order Acceptance

Submitting an order does not necessarily constitute final acceptance of the order by ChowMore.

All orders are subject to acceptance, payment authorization, Product availability, shipping eligibility, purchase limits, and fraud or security review.

We reserve the right, where reasonably necessary and permitted by applicable law, to reject, limit, hold, or cancel an order, including because of:

  • Product or inventory limitations;

  • Pricing, listing, or Website errors;

  • Payment authorization problems;

  • Suspected fraud or unauthorized transactions;

  • Promotion or discount abuse;

  • Shipping restrictions;

  • Suspected resale or commercial distribution; or

  • Other legitimate operational or security circumstances.

If an order is canceled or cannot be fulfilled, any payment-related resolution will be handled in accordance with applicable law, our applicable policies, and the circumstances of the order.

8. Pricing, Taxes, and Payments

Product prices and available promotions are displayed through the Services and may change from time to time.

Applicable taxes and other charges, if any, will be displayed or calculated as required.

We make reasonable efforts to provide accurate pricing and Product information. However, typographical, technical, pricing, promotional, inventory, or other errors may occasionally occur.

We reserve the right to correct errors or inaccuracies and, where permitted by applicable law, reject or cancel affected orders.

Any payment-related resolution associated with such an order will be handled in accordance with applicable law, our policies, and the circumstances of the transaction.

Payments through our Website are processed using Shopify Payments and applicable payment-processing partners.

By submitting payment information, you represent that you are authorized to use the payment method provided and authorize the applicable charges associated with your purchase.

Payment processing may also be subject to terms and policies of Shopify and applicable payment providers.

9. Subscriptions and Automatic Renewals

ChowMore may offer Products through recurring subscription plans.

When you enroll in a subscription, you authorize recurring charges to your selected payment method according to the price, frequency, and other subscription terms presented to you at enrollment, until the subscription is canceled or otherwise terminated.

Your subscription will automatically renew according to the delivery or billing frequency you select unless canceled in accordance with the applicable subscription terms.

Customers are responsible for managing subscriptions and making available changes—including skipping, pausing, modifying, or canceling an upcoming subscription—before the applicable order is processed.

Once a subscription order has been processed, it may immediately enter our fulfillment workflow. We cannot guarantee cancellation or modification after processing.

Refund eligibility for subscription orders is governed by our Refund & Order Issue Policy and applicable law.

If you experience technical difficulty managing your subscription, please contact ChowMore Customer Care at least one full business day before your upcoming renewal date when possible.

Subscription prices, discounts, Products, or benefits may change from time to time. Where required by applicable law, we will provide applicable notice before a material change affects a future recurring charge.

If a subscription Product becomes unavailable or is discontinued, we may pause or cancel the affected subscription or offer another available option, subject to applicable law and any consent requirements.

10. Shipping, Delivery, and Route Package Protection

Shipping locations, processing estimates, delivery estimates, shipping restrictions, order changes, and related requirements are governed by our Shipping & Subscription Policy.

Delivery dates are estimates unless expressly stated otherwise.

ChowMore may offer optional Route Package Protection at checkout.

Route Package Protection is provided through a third-party service and may provide protection for eligible lost, stolen, or transit-damaged shipments, subject to Route's applicable terms, conditions, exclusions, eligibility requirements, and claim procedures.

Route determines eligibility and available remedies for claims submitted under its protection program.

Route Package Protection is separate from ChowMore's handling of Product-quality concerns, manufacturing defects, incorrect items, or ChowMore fulfillment errors.

Declining optional Route Package Protection does not waive any rights or remedies that cannot legally be waived.

11. Refunds, Returns, and Order Issues

Refund eligibility, food-return restrictions, Product-quality concerns, incorrect or missing items, refused deliveries, and other applicable order issues are governed by ChowMore's Refund & Order Issue Policy.

Due to health, safety, and sanitation considerations associated with consumable pet food, physical returns of food Products are generally not accepted as described in that policy.

Nothing in these Terms or our policies limits rights or remedies that cannot be excluded under applicable law.

12. Promotions, Discounts, and Offers

From time to time, ChowMore may offer promotional codes, introductory discounts, referral offers, bundles, credits, or other promotions (“Promotions”).

Promotions may be subject to additional eligibility requirements, expiration dates, Product restrictions, minimum purchase requirements, usage limits, subscription restrictions, and other terms disclosed with the applicable Promotion.

Unless otherwise stated:

  • Promotions are not redeemable for cash;

  • Promotions may not be applied retroactively;

  • Promotions may not be combined or stacked with other offers where prohibited by the applicable Promotion terms;

  • New-customer or introductory Promotions may be limited to one per eligible customer or household; and

  • Promotions may not be sold, duplicated, manipulated, or used through fraudulent or unauthorized methods.

We may reject or cancel the use of a Promotion where we reasonably determine that fraud, manipulation, multiple-account abuse, unauthorized distribution, or other material misuse has occurred.

Any payment-related resolution will be handled according to applicable law, our policies, and the circumstances involved.

13. Personal and Household Use

Unless ChowMore expressly agrees otherwise, Products purchased through the Services are intended for personal or household use.

You may not purchase Products for unauthorized commercial resale, redistribution, export, or other commercial exploitation.

We may reasonably limit quantities or decline orders that appear to involve unauthorized resale, distribution, fraudulent activity, or circumvention of purchase restrictions.

14. Reviews and User Content

The Services may allow customers to submit reviews, photographs, comments, feedback, or other content (“User Content”).

You retain ownership of intellectual property rights you may have in your User Content.

By voluntarily submitting User Content for public posting, review, promotional consideration, or similar public-facing purposes, you grant ChowMore a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, and otherwise use that User Content as reasonably necessary to operate, improve, and promote the Services and Products, subject to applicable law.

This license does not transfer ownership of your User Content to ChowMore.

NOTHING IN THESE TERMS PROHIBITS OR RESTRICTS YOU FROM PROVIDING AN HONEST REVIEW, ASSESSMENT, OR OPINION ABOUT CHOWMORE, OUR PRODUCTS, OR OUR SERVICES.

We may moderate or remove User Content where permitted by law, including content that:

  • Contains confidential or private information;

  • Is unlawful, threatening, harassing, obscene, or abusive;

  • Infringes intellectual property or other legal rights;

  • Contains malicious software or harmful code;

  • Is unrelated to the Product or Service being reviewed;

  • Is knowingly false or misleading; or

  • Otherwise violates applicable law.

Photographs, documents, or information submitted privately to Customer Care for purposes such as reporting damaged Products or obtaining support are not treated as publicly submitted review content merely because they were provided to ChowMore.

15. Intellectual Property

The Services contain trademarks, logos, photographs, graphics, text, designs, recipes, formulations, software, and other materials owned by or licensed to ChowMore or other applicable rights holders (“Content”).

Subject to these Terms, ChowMore grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Services and Content for personal, non-commercial purposes.

Except as permitted by applicable law or expressly authorized by ChowMore or the applicable rights holder, you may not reproduce, distribute, modify, sell, license, commercially exploit, or create derivative works from protected Content.

“ChowMore” and applicable ChowMore names, logos, and branding are trademarks or other proprietary identifiers of ChowMore and may not be used in a manner likely to cause confusion or imply unauthorized endorsement.

16. Prohibited Uses and Fraud Prevention

You may not use the Services:

  • For unlawful or fraudulent purposes;

  • To use stolen, unauthorized, or fraudulent payment information;

  • To circumvent account, Product, Promotion, or purchase restrictions;

  • To introduce malware, viruses, or harmful code;

  • To gain unauthorized access to accounts, systems, networks, or data;

  • To interfere with the security or operation of the Services;

  • To impersonate another person or misrepresent your identity;

  • To engage in unauthorized commercial resale;

  • To manipulate Promotions or subscription offers;

  • To engage in fraudulent chargeback or payment-dispute activity; or

  • To scrape, extract, reproduce, or collect Content or data through automated means in violation of applicable law, these Terms, or technical restrictions we implement.

We may use reasonable fraud-prevention, security, and transaction-review measures to protect ChowMore and our customers.

Nothing in this section restricts a customer's lawful right to initiate a legitimate payment dispute or exercise rights available under applicable law.

17. Third-Party Services and Links

The Services may integrate with or contain links to third-party services, including ecommerce, payment, shipping, package-protection, subscription-management, analytics, session-replay, social-media, and other technology providers.

Examples may include Shopify, Shopify Payments, Route, shipping carriers, and other providers supporting our Services.

Third-party services may be governed by their own terms and privacy policies.

ChowMore is not responsible for third-party websites or services that we do not own or control, except to the extent responsibility cannot be excluded under applicable law.

The inclusion of a third-party link or integration does not necessarily constitute an endorsement of all content, products, or services offered by that third party.

18. Electronic Communications

By using the Services, creating an account, placing an order, or communicating with ChowMore electronically, you consent to receive transactional and service-related communications electronically where permitted by law.

These communications may include:

  • Order confirmations;

  • Payment and transaction notices;

  • Shipping and delivery updates;

  • Subscription notices;

  • Account and security communications;

  • Product-safety or recall notices; and

  • Customer-support communications.

Marketing email or SMS communications are subject to applicable consent requirements and your communication preferences.

Purchasing a Product or merely using the Website does not, by itself, constitute consent to receive promotional SMS communications where separate consent is required.

You may unsubscribe from promotional communications using the applicable opt-out mechanism. Opting out of marketing does not prevent us from sending necessary transactional or service-related communications.

19. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO HAVE CERTAIN DISPUTES DECIDED BY A COURT OR JURY AND THE ABILITY TO PARTICIPATE IN CERTAIN CLASS OR REPRESENTATIVE ACTIONS.

19.1 Informal Dispute Resolution

Before initiating arbitration, the party asserting a dispute should provide the other party with written notice describing the nature of the dispute and requested resolution.

The parties agree to make a good-faith effort to resolve the dispute informally for at least 30 days after receipt of the notice before commencing arbitration, unless applicable law requires otherwise.

Notices to ChowMore may be submitted through the contact information provided at the end of these Terms.

19.2 Individual Arbitration

Except for disputes that qualify for an exception described below, disputes arising from or relating to these Terms, the Services, or Products that cannot be resolved informally will be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules, as modified by these Terms to the extent permitted.

The arbitration agreement is intended to apply only to the extent permitted by applicable law.

19.3 Small Claims Court

Notwithstanding the arbitration provision above, either party may bring an eligible individual claim in a court of competent jurisdiction that qualifies as a small claims court, provided the claim remains within that court's jurisdiction and proceeds on an individual basis.

19.4 Intellectual Property and Unauthorized Access

Either party may seek appropriate judicial relief concerning infringement or misuse of intellectual property rights.

ChowMore may also seek appropriate judicial relief concerning unauthorized access to or interference with its systems, fraud, theft, or other conduct for which immediate equitable relief may be legally available.

19.5 Class and Representative Proceedings

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND CHOWMORE AGREE THAT COVERED DISPUTES SUBJECT TO ARBITRATION WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Any limitations on class, collective, consolidated, or representative proceedings are subject to applicable law and the applicable arbitration rules.

19.6 Arbitration Administration

Arbitration fees, procedures, location, hearing format, and other administrative matters will be governed by the applicable AAA Consumer Arbitration Rules and applicable law.

If AAA is unavailable or declines to administer a dispute, the parties may seek an appropriate substitute arbitration administrator or other resolution as permitted by applicable law.

19.7 Rights That Cannot Be Waived

Nothing in this Section prevents either party from exercising rights or pursuing remedies that cannot lawfully be waived or subjected to arbitration.

BECAUSE THIS SECTION CONCERNS IMPORTANT LEGAL RIGHTS, CHOWMORE RECOMMENDS THAT CUSTOMERS REVIEW IT CAREFULLY.

20. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, EXCEPT FOR EXPRESS PRODUCT REPRESENTATIONS, WARRANTIES, OR RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED.

CHOWMORE DOES NOT WARRANT THAT THE WEBSITE OR SERVICES WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CHOWMORE DISCLAIMS IMPLIED WARRANTIES TO THE EXTENT THEY MAY LAWFULLY BE DISCLAIMED.

Nothing in this Section eliminates express representations ChowMore makes regarding a particular Product or any warranty, remedy, or consumer right that cannot legally be excluded.

21. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CHOWMORE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, TO THE EXTENT SUCH DAMAGES MAY LAWFULLY BE EXCLUDED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CHOWMORE'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR PURCHASE, PRODUCT, OR TRANSACTION WILL BE LIMITED AS PROVIDED BY APPLICABLE LAW AND ANY EXPRESS RIGHTS OR REMEDIES PROVIDED UNDER CHOWMORE'S APPLICABLE POLICIES.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY, WARRANTIES, REMEDIES, OR CONSUMER RIGHTS TO THE EXTENT THEY CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

22. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless ChowMore and its affiliates, officers, directors, employees, and agents from third-party claims, liabilities, damages, and reasonable costs arising directly from:

  • Your unlawful or fraudulent use of the Services;

  • Your material breach of these Terms;

  • Your violation of another person's intellectual property or other legal rights through User Content you submit; or

  • Your unauthorized commercial exploitation of the Services or Products.

This Section does not require you to indemnify ChowMore for matters arising from ChowMore's own conduct where such indemnification would be prohibited by applicable law.

23. Events Outside Our Reasonable Control

ChowMore will not be responsible for delays or failures in performance caused by events outside our reasonable control, including severe weather, natural disasters, transportation or carrier disruptions, labor disruptions, widespread technology or infrastructure failures, governmental actions, emergencies, or similar events.

This Section does not limit rights or remedies that cannot be waived under applicable law, including applicable rights concerning delayed or unshipped merchandise.

24. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent federal law or other applicable law requires otherwise.

The governing-law provision does not deprive consumers of protections that cannot lawfully be waived under the laws applicable to them.

For disputes not subject to arbitration or eligible small-claims proceedings, jurisdiction and venue will be determined in accordance with applicable law.

25. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, Products, business practices, policies, technologies, or applicable legal requirements.

When we update these Terms, we will update the “Last Updated” date at the top of this page.

Where required by applicable law, we will provide additional notice or obtain consent regarding material changes.

Changes will apply prospectively as required by applicable law and will not retroactively eliminate rights that have already accrued where such elimination is prohibited.

26. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed as appropriate, and the remaining provisions will remain in effect.

The arbitration provisions may be subject to additional severability requirements under applicable law and applicable arbitration rules.

27. No Waiver

ChowMore's failure or delay in enforcing a provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

A waiver of one provision or instance does not constitute a waiver of another provision or subsequent instance.

28. Assignment

You may not assign or transfer your rights or obligations under these Terms without ChowMore's prior written consent, except where applicable law provides otherwise.

ChowMore may assign or transfer these Terms in connection with a merger, acquisition, corporate reorganization, financing, sale of assets, or similar business transaction, subject to applicable law.

29. Entire Agreement and Incorporated Policies

These Terms, together with policies and terms expressly incorporated by reference, constitute the agreement between you and ChowMore concerning your use of the Services and purchase of Products.

The following ChowMore policies are incorporated into these Terms where applicable:

If these Terms conflict with a more specific ChowMore policy or offer applicable to a particular transaction, the more specific terms will control with respect to that subject matter to the extent permitted by applicable law.

With respect to the collection, use, disclosure, or processing of personal information, the Privacy Policy controls to the extent of any conflict.

30. California Consumer Notice

California consumers may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs regarding unresolved complaints.

Applicable contact information is available through the California Department of Consumer Affairs.

Nothing in this Section limits any other rights available under California law.
